These Terms & Conditions ("Terms") are a legal agreement between you and JAL Technology LLC ("JAL Technology", "DMLAI", "we", "us" or "our") and govern your access to and use of dmlai.com and our AI photo generator, AI content tools, AI reel & video makers, AI voiceover & dubbing, subtitle generator and related services (the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms. By using the Services, you represent that you meet these requirements and that your use complies with all laws that apply to you.
2. The Services
DMLAI provides free, AI-powered tools to generate and edit images, captions, hooks, hashtags, subtitles and similar content. The Services are provided on an "as is" and "as available" basis. We may add, change, suspend or discontinue any part of the Services at any time, and we may set usage limits or apply fair-use measures to keep the Services available to everyone.
3. Acceptable use
You agree not to use the Services to create, upload, generate, or share content or to act in any way that:
- Is illegal, or infringes or violates anyone's intellectual property, privacy, publicity, or other rights;
- Depicts child sexual abuse material (CSAM) or sexualizes minors in any way — this is strictly prohibited and may be reported to authorities;
- Is non-consensual intimate imagery, sexual content involving real identifiable people, or harassing, hateful, defamatory, or violent content;
- Creates deepfakes or realistic depictions of real, identifiable individuals without their consent, or impersonates any person or entity;
- Is intended to deceive or defraud, spread misinformation, or present AI-generated content as authentic where doing so is unlawful;
- Contains malware, or attempts to scrape, overload, reverse-engineer, or disrupt the Services or their underlying providers;
- Uses the Services' outputs to train or develop a competing AI model, or removes any provenance, watermark, or AI-disclosure markings where required by law.
You are solely responsible for your prompts, your uploads, and how you use any output. We may remove content and suspend or terminate access for violations.
4. Your content & uploads
You retain ownership of the content you upload ("User Content"). You represent and warrant that you own or have all necessary rights and permissions to your User Content and that it does not violate these Terms or any law or third-party right. If your upload contains other people, you confirm you have any consent required to use their likeness. This includes photos of children (for example, a childhood photo used for the "Younger Self" effect) — you confirm you are the person pictured or have the right to use the photo. You must not use the Services (including AI images or AI voiceovers) to impersonate any person, to deceive, or to create unlawful, defamatory or misleading content presented as real.
You grant JAL Technology LLC a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your User Content solely to operate and provide the Services to you (including sending it to the AI providers that generate your requested output). We do not claim ownership of your User Content and do not use it to identify you.
5. AI output & ownership
Subject to these Terms and your compliance with them, as between you and us, you own the images and content you generate with the Services ("Output"), and you are free to use them, including for commercial purposes.
Please understand: (a) AI Output is generated automatically and may be inaccurate, generic, or unintentionally similar to other works; (b) identical or similar prompts may produce similar Output for other users, so your Output may not be unique and we cannot grant you exclusivity; (c) under current U.S. law, content created without sufficient human authorship may not be eligible for copyright protection; and (d) you are responsible for reviewing Output and ensuring your use of it is lawful and does not infringe others' rights before publishing or commercializing it.
5A. Video credits, payments & AI video
Some features — including the AI Video generator (which turns a description into a talking AI video where characters speak their lines with lip-sync, plus an AI voiceover), and other premium generation — are paid and run on pre-paid video credits. Free tools (such as the Reel Maker, image tools, subtitles and dubbing) may use third-party or in-browser engines and are offered on a best-effort basis. By buying or using credits you agree that:
(a) credits are pre-paid and each successful AI video generation consumes one or more credits; (b) because each generation incurs real third-party compute cost, credits are non-refundable once used; (c) unused credits stay in your account but have no cash value and are non-transferable; (d) prices, credit costs and pack sizes may change at any time; (e) if a generation fails on our side we aim not to deduct a credit, but we are not liable for the quality, style, motion, lip-sync, likeness or usefulness of any Output; and (f) payments are processed by our payment provider (Stripe) — we never see or store your full card details; and (g) the exact length and price of every video is shown to you BEFORE you pay or start generation — by starting a generation you authorize that charge and agree that, because third-party compute cost is incurred immediately, the payment is final and non-refundable once generation begins, except as set out in our Refund Policy (e.g. failed generations are re-credited).
AI-generated video, voice, images and text are produced automatically and may contain errors, artefacts, imperfect motion or imperfect lip-sync — results vary by scene and are not guaranteed. Generated files may be hosted by third parties and may not remain available indefinitely, so please download anything you want to keep. You are responsible for reviewing all Output before posting, disclosing AI-generated content where required, and complying with each platform's rules. Free and experimental features may change or be removed at any time.
5B. How talking-video pricing & limits work
Talking AI video (Talking Photo, AI Video generator, Product Ad Maker) is a paid, pay-per-video feature. All other tools on DMLAI are free.
(a) Billing is per second of generated video; the exact length and price are shown before you pay. (b) Pro motion and 720p HD cost twice the base per-second rate. (c) In the multi-scene AI Video generator, each scene is a separate paid clip. (d) Engine limits apply: Pro motion supports up to about 30 seconds per clip, Standard up to about 3 minutes; scripts longer than the limit must be shortened or split. (e) Videos are produced by third-party AI engines; occasional queue delays or transient failures can happen — where a paid generation fails and produces no video, your balance is automatically restored. (f) Free previews (voice preview, price/length estimate, completeness check) are provided so you can verify your settings before paying, and we recommend using them.
5C. Voice cloning & likeness
If you use voice cloning or upload a photo of a person, you confirm that you are that person or have their explicit permission. You must not clone a voice, use a face, or imitate any individual — including public figures — without consent, and you must not use DMLAI to create misleading, defamatory, political-deception or fraudulent content. Voice samples and photos are sent to our AI providers only to produce your video. We may suspend accounts that break these rules.
5D. Early access & availability
Some features (including the talking-video suite) may be limited to selected accounts during private testing, and may be enabled, disabled, priced or changed at any time. Free tools remain available to all users, subject to fair use.
6. Our intellectual property
The Services, including the DMLAI name, logo, website, design, text, and software, are owned by JAL Technology LLC and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services except as expressly permitted.
7. Third-party services
The Services rely on third-party providers (for example, hosting and AI model/image-generation providers). Your use of features powered by them may also be subject to their terms, and we are not responsible for third-party services. Links to third-party websites are provided for convenience and we do not endorse or assume responsibility for them.
8. Disclaimers
The Services and all Output are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or that any Output will be accurate, reliable, appropriate, or fit for your intended use. You use the Services and Output at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, JAL Technology LLC and its owners, employees and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of (or inability to use) the Services or Output.
Our total aggregate liability for any claim relating to the Services will not exceed one hundred U.S. dollars (US$100), or the amount you paid us for the Services in the 12 months before the claim, whichever is greater.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnification
You agree to indemnify and hold harmless JAL Technology LLC and its owners, employees and providers from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising from your User Content, your Output, your use of the Services, or your violation of these Terms or any law or third-party right.
11. Copyright complaints (DMCA)
We respect intellectual-property rights. If you believe content available through the Services infringes your copyright, send a notice to support@dmlai.com including: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and where it is located; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (6) your physical or electronic signature. We may remove infringing material and terminate repeat infringers.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination (including Sections 5, 6, 8, 9, 10, 11 and 13) will survive.
13. Governing law & dispute resolution
These Terms are governed by the laws of the State in which JAL Technology LLC is organized and the applicable federal laws of the United States, without regard to conflict-of-law rules.
Informal resolution: Before filing any claim, you agree to first contact us at support@dmlai.com and try to resolve the dispute informally for at least 30 days.
Binding arbitration & class-action waiver: To the extent permitted by applicable law, any dispute that is not resolved informally will be settled by final and binding individual arbitration, and not in a class, collective, or representative action. You and we waive the right to a jury trial. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.
If you are a consumer in the EU, UK, or another region whose laws give you mandatory rights, nothing in this Section removes those rights, and you may bring claims in your local courts where the law requires.
14. AI transparency, deepfakes & your legal duties
Everything DMLAI produces is synthetic media generated by AI. Many countries now require AI content to be labelled (for example the EU AI Act transparency rules, and various national election and advertising rules). You are solely responsible for complying with the laws of every country where you publish.
You agree that you will not use DMLAI to: impersonate any real person without written consent; create sexual, nude or intimate imagery of any person; create any sexual or exploitative content involving minors; produce election, political or government-related deepfakes; fabricate statements by public figures, journalists, officials or brands; create content that harasses, defames, threatens or discriminates; imitate a real news organisation or claim official status you do not have; produce medical, legal, financial or safety advice presented as professional advice; or infringe copyright, trademark, personality or publicity rights. You will also disclose that content is AI-generated wherever required by law or platform policy.
15. Face & voice data (biometric notice)
To make a talking video we process the photo and, if you use voice cloning, the voice recording you provide. Some laws (for example Illinois BIPA, Texas CUBI and similar) treat face or voice data as biometric information.
(a) DMLAI does not run facial recognition, identity matching or biometric surveillance and does not build biometric profiles; (b) uploads are used only to generate the video you requested and are passed to our AI providers for that purpose; (c) by uploading, you confirm you are the person shown/heard or have that person's explicit permission; (d) we retain what is needed to deliver and store your project and delete or anonymise it when it is no longer needed, or on your request; (e) if you are in a region requiring separate written biometric consent, uploading the file constitutes that consent for this limited purpose. Do not upload other people's faces or voices without permission.
16. Age, sanctions & export
You must be at least 18 years old (or the age of majority where you live) to buy anything, and at least 13 (16 in some regions) to use free tools with a guardian's consent. The Services are not directed to children.
You may not use the Services if you are located in, ordinarily resident in, or acting for anyone in a country or region subject to comprehensive United States sanctions or embargo, or if you are on any restricted-party or denied-persons list. You agree not to export, re-export or use the Services in violation of US or other applicable export-control and sanctions laws.
17. Prices, taxes, currency & payment disputes
All prices are shown and charged in US dollars and may change at any time. Any local taxes, VAT, GST, customs, bank charges, currency-conversion fees or interchange costs are your responsibility unless we state otherwise. Payments are processed by Stripe and are also subject to Stripe's terms; we never see or store full card details.
Chargebacks: if you dispute a charge for a video that was successfully generated and delivered, we may present these Terms, the pre-payment price screen and your generation logs as evidence. Abusive or fraudulent chargebacks may result in immediate suspension, loss of remaining balance, and recovery of costs. If you believe a charge is wrong, contact us first — see our Refund Policy, which forms part of these Terms.
18. Beta features, availability & force majeure
Features may be released as early access, beta or private testing; they can be changed, limited, priced or withdrawn at any time. The Services are provided on an "as available" basis with no uptime guarantee. We are not liable for delays or failures caused by events outside our reasonable control, including third-party AI provider outages, rate limits or price changes, internet or hosting failures, cyber-attacks, government action, or natural events.
19. Third-party AI providers & your data
DMLAI is built on third-party AI infrastructure. Depending on the tool you use, your text, photo or voice sample may be processed by providers such as OpenAI (text and voice), Google Gemini (image editing/enhancement), fal.ai and its model partners such as VEED, ByteDance and MiniMax (talking video and voice cloning), Pollinations (free image generation), Supabase (accounts and project storage) and Stripe (payments). Their processing is governed by their own terms and privacy policies, and their behaviour, quality and availability are outside our control. See our Privacy Policy for details.
20. General terms
Entire agreement: these Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us. Severability: if any part is held invalid, the rest remains in force. No waiver: a delay in enforcing a right is not a waiver of it. Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. Electronic communications: you consent to receive notices, invoices and legal communications electronically at the email on your account. Language: the English version of these Terms prevails over any translation. No partnership: nothing here creates any employment, agency, partnership or franchise relationship. Feedback: if you send us ideas or feedback, we may use them without obligation.
21. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, give additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
